Information Support Australia Pty Ltd (trader as Super Information Team) paid a offense notice of $ 102,120 and will be subject to an independent review after the Australian Communications and Media Authority (ACMA) finds it violates telemarketing rules.
An ACMA investigation into complaints about Super Information Team found that it was responsible for 880 calls to phone numbers on the Do Not Call register in October 2020. The calls were made through a call center. ‘third party calls and offered beneficiaries a review of their retirement pension and put them in touch with a financial advisor.
ACMA President Nerida O’Loughlin said illegal marketing of financial services is an ACMA compliance priority given the potential for harm, especially at a time when many Australians are struggling financial due to COVID restrictions.
“Spam telemarketing causes frustration and anxiety, and the do not call registry is your phone’s equivalent of a ‘No Spam’ sticker on your mailbox,” Ms. O said. ‘Loughlin,
“Super Information Team did not have adequate compliance systems in place to prevent calls to registry numbers by an outsourced provider. You cannot outsource your compliance obligations. If a third party is working on your behalf, it is your responsibility to ensure that you follow the telemarketing rules.
“The size of this violation notice sends a message to telemarketers that we will not hesitate to take action against those who break the rules.”
Super Information Team is also subject to a binding commitment which will enable it to implement the recommendations of an independent review of its compliance operations.
Ms O’Loughlin said ACMA will pay close attention to how Super Information Team meets its commitments under the pledge to prevent future breaches.
In the past 18 months, businesses have paid $ 1,797,000 in violation notices for breaking telemarketing and spam laws.
Enforcement actions for breaches of Australia’s unsolicited communications laws may include formal warnings, notices of breach, binding warrants and actions in Federal Court.
